Terms and Conditions of Use

With an aim to provide quality and improved learning options for all its users and thus ensuring enhanced experience of the learning platform, Polyglot Institute Oman LLC., through the Polyglot Academy, has defined the Terms and Conditions of Polyglot’s websites, apps and its various courses and programmes. Polyglot Academy offers both virtual learning, which is guided by tutors/ instructors and also an eLearning platform to offer users excellent courses and content for their skill and knowledge enhancement.

The rules stated in the Terms and Conditions ensures the safety of use for us and all our users, including students and instructors. All services offered are subject to User’s acceptance of the Terms and Conditions and any other applicable terms and conditions, operating rules, policies and procedures that are communicated from time to time on or through the Platform by Polyglot Academy.

Polyglot Academy Platform’s Terms and Conditions of Use are applicable to all user activities relating to our website, mobile/smart phone applications, tablets, or any other devices.

Users accessing or browsing our platform or content or service is automatically required to read and understand all Terms and Conditions for use carefully. In the event that the user is not in acceptance of the terms or has not been able to comprehend the terms, it is advisable not to access or browse our platform or website and is further requested to Contact us for any clarifications.

Category of Users:

Below categorization is made based on the content users can access and/or contribute to.

Users: these users can visit and access the platform and have access to informative content. Contents posted by sponsored contributors, it shall be identified accordingly. Access shall be available to all articles, comments, reviews, events and press releases and Job postings
Registered Users (student): these users shall have a registered account with us and can have access to more contents and educational materials. Limited access to download materials, workshops and/ or Webinars hosted by Polyglot Academy.

User Account:

User accounts is essential for performing most activities like registering in course, access / download of educational and informative contents, submitting course assignments, uploading or submitting educational materials and contents, etc. User accounts are unique to a person and all users are required to provide accurate and valid information while account creation. User shall have complete responsibility with regard to the use of their accounts. This shall also include responsibility for any action of harm or damage caused through a user account by the user itself or by unauthorized use of the account. User account credential request, in the event of forgetting password or user name, shall be provided only to authorized users based on the personal data proof provided by the user at the time of request which shall be counter verified with the original details furnished at the time of creating the account.

All User account credentials have to be maintained in confidentiality and shall not be shared with anyone. In the event of suspicion of account compromise or breach of security, user is required to communicate to privacy@polyglot.org with details.

Polyglot Academy is available for all age users. However, actions performed in the platform by minor users shall be under responsibility of their parents/ guardian.

For account creation of users requiring to upload or post contents, Polyglot reserves the right to confirm the identity of such users before providing access.

Users can close a User Account by contacting Polyglot Academy. Privacy Policy shall be applicable relating to user personal data in the event of Account termination.

Registrations and Access Time limit:

On registration into a course, students are provided with Lifetime access which is non-transferrable, unless the account is terminated or has to be closed due to security or policy reasons. The access provided shall be applicable for free or paid courses. On payment of requisite fees pertaining to the course registered in access shall be limited to the specific course information and content. All terms and conditions specific to the course or service registered for shall be applicable in this case. Lifetime access shall not be applicable to specific features of the course and shall be limited for certain period of training only. Polyglot Academy reserves the right to define the time limit for provision of such features.

Students are not allowed to reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course or educational material without explicit permission in writing duly signed by a Polyglot Academy authorized representative.

By uploading course content and materials in the Polyglot Academy platform, Trainers/ Instructors hands in the intellectual property rights to Polyglot Academy, allowing it to offer access to such courses and contents to the students and certain users. All such courses offered are the property of Polyglot Academy and Users both students and Trainer/ instructors are not permitted to sell them to third party, share or put for public use without knowledge and authorization from Polyglot Academy.

Payments and Offers:

All services shall be offered at price reasonably determined by Polyglot Academy and shall take into account the various offers, discounts and promotions that will be applicable from time to time. Prices may be offered differently for virtual learning and eLearning options. All promotions shall be applied for specific period of time. All offers shall be applicable for the specified validity period only.

All Rate shall be applicable in US Dollar, However, based on the location of user account login, the currency and relevant taxes shall be applicable as per the applicable exchange rates and bank charges.

All payment are required to be processed through valid payment method. In the event that your payment method is unsuccessful and you still get access to the course you are enrolling in, you shall agree to pay us the corresponding fees within fifteen (15) days of notification from us. We reserve the right to disable access to any course for which we have not received adequate payment.

Rules for Content Use:

Users are required to comply with applicable local laws and regulations of their country and shall be responsible for being aware of and compliance with such laws and regulations. Use of the Services or creation of the account for illegal purposes is not permitted.

STRICTLY PROHIBITED CONTENTS

The following contents are strictly prohibited in the Polyglot Academy Platform-

Content that defames, harasses or threatens others;
Content that discusses illegal activities with the intent to commit them;
Content that infringes another’s intellectual property, including, but not limited to, copyrights or trademarks;
Profane, pornographic, obscene, indecent, racist or unlawful content;
Advertising or any form of commercial solicitation;
Content related to partisan political activities;
Viruses, trojan horses, worms, time bombs, corrupted files, malware, spyware, or any other similar software that may damage the operation of another’s computer or property; and
Content that contains intentionally inaccurate information or that is posted with the intent of misleading others.

Users may not submit, post, publish, share, or otherwise distribute any of the above Strictly Prohibited Items on or via the Polyglot Academy Platform.

Polyglot Academy also reserves the right to remove any contents or course posted by Users that are found to be violating the Intellectual Property Policyor is objectionable or inappropriate or if against the governing laws and regulations.

Polyglot Academy may terminate or suspend user permission to use the platform and Services or ban user account at any time, with or without notice, for any or no reason, including for any violation of these Terms –

if user fails to pay any fees when due,
upon the request of law enforcement or government agencies,
for extended periods of inactivity,
for unexpected technical issues or problems, or
if it is suspected that user engaged in fraudulent or illegal activities, or
for any other reason in our sole discretion.

Upon any such termination Polyglot Academy may delete the user account and content, and may prevent the user from further access to the platforms and use of our Services. The User content may still be available on the platforms even if the user account is terminated or suspended. The user agrees that Polyglot Academy will have no liability to either the user or any third party for termination of the user account, removal of user’s content, or blocking of user access to our platforms and services.

If one of Polyglot Academy instructors have published a course that infringes User copyright or trademark rights, User is requested to inform us. Our Trainer/ Instructor are bound to follow the law and respect the intellectual property rights of others.

Rights to Content Posted:

Users allow Polyglot Academy to use or share the content or courses through any form to others including promotion and advertisement of such contents/ course.

Third Party Content

Through the Services, you will have the ability to access and/or use content provided by instructors, other users, and/or other third parties and links to websites and services maintained by third parties. Polyglot Academy cannot guarantee that such third party content, in the Services or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. Polyglot Academy disclaims any responsibility or liability related to your access or use of, or inability to access and use, such third party content.

Feedback:

All users are welcome to post their suggestions, ideas, comments, and other feedback regarding their experience with Polyglot Academy. Submission of Feedback by user automatically grants us the right to use the Feedback without any restriction or any compensation to the user.

Security:

Polyglot Academy respects the intellectual property rights of our users, Content Providers, and other third parties and expects our users to do the same when using the Services.

Disclaimers

The Services and all included content are provided on an “AS IS” basis without Warranty of any kind, whether express or implied. Polyglot Academy specifically disclaim any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade. The Polyglot Academy further disclaim any and all liability related to your access or use of the services or any related content. You acknowledge and agree that any access to or use of the services or such content is at your own risk.

Limitation of Liability

To the Maximum extent permitted by Law, Polyglot Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the services;
Any conduct or content of any party other than the applicable Polyglot Academy party, including without limitation, any defamatory, offensive, or illegal conduct; or
Unauthorised access, use, or alteration of your content or information.

In no event shall Polyglot Academy’ aggregate liability for all claims related to the services exceed the total amount of fees received by Polyglot Academy from you for the use of paid services.

You acknowledge and agree that the disclaimers and the limitations of liability set forth in this terms of Use reflect a reasonable and fair allocation of risk between you and Polyglot Academy parties, and that these limitations are an essential basis to Polyglot Academy’s ability to make the services available to you on an economically feasible basis.

You agree that any cause of action related to the services must commence within one year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

Indemnification

You agree to indemnify, defend, and hold harmless the Polyglot Academy Parties from any and all claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.

Legal Actions and Notices

Any action, regardless of form, arising out of or relating to this Agreement is valid to be brought by either party only within one (1) year after the cause of action has accrued.

Any notice or other communication to be given hereunder will be in writing and given by registered or certified mail return receipt requested, or by email. User registered email account shall be considered for this purpose. Notices to Polyglot Academy may be addressed to notice@polyglot.org

Governing Law and Jurisdiction

The Services are managed by Polyglot Institute Oman LLC., which is located in the Sultanate of Oman. You agree that any dispute related to these Terms will be governed by the laws of the Sultanate of Oman, excluding its conflicts of law provisions. You further consent to the personal jurisdiction of and exclusive venue in the federal and state courts located in and serving the Sultanate of Oman as the legal forum for any such dispute.
